Regular Holidays
Regular holidays are those recognized by the law. For instance, we have holidays like New Year’s Day, January 1, Independence Day, June 12, National Heroes Day, August 25 or last Monday in August, and Christmas, December 25.
Having to work on Regular Holidays is compensated with the provision of additional pay as explained by the Labor Code. Generally, for work done during a Regular Holiday, an employee who should work would be paid about 200% of the regular pay for the first 8 hours and about 300% for overtime work. Conversely, if a Regular Holiday falls on a scheduled day off, an employee will still be accorded his or her regular pay he or she earns.
Special (non-working) Holidays
Special Holidays are declared by law, but most of the time by way of proclamation of the president and some LGUs. Sample occasions are Evelio Javier Day (Panay Island), Ninoy Aquino Day (August 21), and locally celebrated holidays. Employees working on Special Holidays get the daily wage only. If they work over 8 hours, they get overtime pay but the rate is less than for Regular Holidays – most of the time it is 130% of their normal rate for working on that Special Holiday.
